Can i register a Trademark name as a new domain tld ? For example a new TLD came in market like .ws, .info etc. Can i register already registered Trademark name for example microsoft.ws or microsoft.info etc and use it for advertising purpose or contact microsoft to sell this ? Is this legal ? I know microsoft is really big.. Take another example.. How bad it is if i am in USA and do it or in another country ? Just to add another scenario: What if they get Trademark after i registered domain ? Like i registered my domain on 2000 and they got trademark on 2001 ? One more question: What if i already registered it. I don't know about all these laws and cybersquatting. Please suggest. I don't want to get into legal case.

Should I register a trademark before or after launch? I want to register the trade mark for my brand name and intend to launch it. I want to know, if I do not trademark the name but it receives massive media coverage will that be sufficient enough for someone not to trade mark the name? If it is known in the media exposure that it is my brand and I created it, but have not trademarked it, will I lose out if someone else tries to trade mark it?
Can I register a trademark for a word that I did not invent? Here's a hypothetical situation: Let's say I publish a fictional novel and it becomes a best-seller. In the book, I portray characters drinking a fictional soda named, "Black Sauce." Can someone legally trademark the term "Black Sauce" as the proposed name for their own soft-drink without my consent? NOTE: This is NOT a real trademark query. "Black Sauce" is a silly name I came up with to discuss the larger issue of registering a trademark that an author invents.
How can I patent/trademark/register an idea? I have a great idea for an invention I know would work. Fortunately it doesn't seem to be on the market. How can I secure this idea so I am the only one with rights to it, and after developing a prototype, a patent so I alone can own rights to the inverntion.idea. thanks. it seems as something similar to my idea is being tested/developed, but my ideas seems to be more efficient. So in a way I want to improve the idea that is being tested although it is still not produced.

For trademark protectition of a word " ie bodog, digg" do i register trademark in US alone or in every country What im trying to understand is companies like Bodog, Digg etc have registered the words Digg,Bodog etc and hence no one can buy a domain with the words in. My question is I want simular protection of "myname" , so that once I start a business "myname" cannot be used by other internet site owners trying to cash in etc. Did the sites like Digg and bodog simply register a trademark in the USA alone or do i have to register a trademark across every nation in the world. Thanks
What are the consequences of changing the design of my registered trademark? I have a my company logo registered as a trademark in several countries. In some countries it is still pending. If I wanted to change the logo design, what are the consequences for my trademark filing? Some people have said that it will restart the process, so registered trademarks will again be pending. And trademarks that were pending will be reset, so it's like filing a new application. Can anyone give a clear answer on this?

How can I found out if a company will file a lawsuit against me if I use the same name/trademark? Basically, I am starting a business and there are two companies that already have the name that I want to use. One company explicity states that their name is a registered trademark on their site. I am sure that the other company does too. One company is a Dutch IT firm and the other is an international nightclub with locations in St. Barth's, New York City and the Hamptons. My company will be in a completely distinct and different industry. What I want to know is, can i register my company (as an official trademark) using the same name given that it is in a different industry. Is there a good chance that they will try to sue me if they find out about my company name? I am more worried about the nightclub than the IT people but both pose a threat clearly.
How do I register my business/clothing brand name? I chose a name for my company. Under this name, I want to run a night club promoting company, start a clothing brand with the same name, and several other business using the same name. Trademark: I paid the initial fee of app $375 but was later informed that my name was DEAD. WHY? I paid approximately $375 online (at trademark website) to register several trademarks. About 5 months later I received some papers in the mail from the trademark office, and assumed they told me that my names were protected. (I was busy with some business issues). However, now I do a search of their website and find that it states that my names are DEAD. What step did I miss in order to truly secure my trademarks?? Pt 2) Can I register a trademark and include both the image/graphic/logo and the name of the company, simultaneously? Example: Using the image of a whale without a head with the words "Save The Planet, Inc". Thus protecting both the company name "Save The Planet" and the image of the whale with no head. Thus protecting both my company image/logo and my company name simultaneously?
May I title my new book using an already registered trademark name? My book is about helping one's self. The existing trademark name belongs to a medical devices manufacturer -- a company that is in a completely different field whatsoever, with NO possible way of being confused with such a book or its work. It seems that an author should be able to, but these matters are legal, not commonplace. I have contacted their company trademark attorney on record, as found through the USPTO.gov web site. No word yet, although it is the holiday season. In the interim I was hoping someone might know. Thoughts?
