Cease and desist letter for trademark infringement w/domains I created. Do I have to transfer them? A real estate developer is starting a new subdivision called "Appleyard" (changed name to protect me). They own the domain www.appleyard.com. I created several domains such as www.myappleyard.com, www.sellappleyard.com, etc. They do have a legitimate trademark with "Appleyard". They recently sent a cease and desist letter giving me a week to respond and transfer all of the domains I created to them. I want to do the right thing, if I'm wrong I'll transfer them. I want to create real estate sales by acting as a buyer's agent for this new subdivision. These domains were to create some of this business. Again "Appleyard" is made up, I didn't want to use the actual name here in this public forum. Anyone know for certain if I could keep the domains and sell advertising on it legally? (2) If the Shop Owner fails to provide complete contact details and legal information, then the products of his shop will not be released for viewing to the end customer and cannot be ordered. (3) Incorrect information in the “legal information” will result in the immediate cancelation of the shop and the withholding of possible existing commissions. § 5 Payment of the Shop Owner (1) The Shop Owner receives a commission for every product, for which he has set a commission, sold in his Shop, excluding returns. (2) The amount of the commission is set by the Shop Owner via the Shop Administration interface for each individual product offered for sale. (3) The product price is the Spreadshirt base price, plus design fees, plus Shop Owner added commission. Spreadshirt reserves the right to change of the base price of Spreadshirt products at any time. (4) Settlement and payment of the commission to the Shop Owner will be made quarterly within 45 days of the end of a calendar quarter. The minimum amount payable is $25.00 USD. If the commission exceeds an amount of $100.00 USD, then the shop owner can request payment at any time, but not more often than once a month. Spreadshirt can decide if payment is made per transfer or cheque. Amounts which lie beneath the minimum amount payable are paid after cancellation of all agreements between Spreadshirt and the Shop Owner regarding the Shop within six months of the cancellation coming into effect, if no new agreement is made by Spreadshirt and the Shop Owner within this period. (5) The Shop Owner is responsible for providing Spreadshirt with his current, required, valid payment details. The Shop Owner will be held liable for providing incorrect payment details. The Shop Owner is also responsible for providing Spreadshirt with his state tax identification number if payment of commissions is made including the statutory sales tax. If no tax number is provided then payment of commissions is made without sales tax. § 6 Embedding of the Partner Shop by the Shop Owner (1) The Shop Owner can publish the Shop on his website; however, there is no obligation to do so. It is published via an electronic reference (“link”) provided by Spreadshirt, which the Shop Owner embeds in his website and which refers to the Shop of the Shop Owner. If it is published, the Shop Owner is committed to include the link generated by Spreadshirt without changes. In particular, the Shop Owner is not permitted to carry out changes which are related to the electronic advertisement linked to the shop or the publishing of general terms and conditions for the end customer. (2) On request, a Shop free of advertisement can be acquired in return for a monthly fee. § 7 Privity of Contract with End Customers; Rights to Change Service (1) Customers purchasing products via the Shop are customers of Spreadshirt. An independent privity of contract is created between customers and Spreadshirt, which is independent of a possible privity of contract between the Shop Owner and the customer who visits the non-shop pages of the Shop Owner. Thus, only the rules, guidelines and business practices of Spreadshirt regarding customer´s orders, customer service and product sales apply to the customer. (2) Spreadshirt can change Shop Administration, shop offerings, product offerings, guidelines, pricing, availability, business operations, and order processing at any time, and temporarily. § 8 Inquiries / Purchase Order Processing (1) Spreadshirt reserves the right to reject inquiries and orders which do not meet the respective requirements set by Spreadshirt. (2) Spreadshirt reserves the right to reject orders from customers who are known for not being credit-worthy or show as being a credit risk. (3) Spreadshirt is responsible for all processing and execution of orders. In this respect, Spreadshirt creates i.e. order forms, books payments, executes cancellation and returns and is responsible for the customer service. § 9 Sales Reports Spreadshirt registers the sales made through the Shop and provides the Shop Owner with a summary of the statistics. Finding the name of a buisness owner? I am trying to sue a buisness. I need the name of the person who owns the buisness and the buisness license number. I have talked to everyone from the county clerk to the secretary of state. No one can help. The only thing I found out is they are a computer store and do not require a license or buiness number to operate, so I guess I don't need it to file the papers for claims court??I also went to the secretary of state's website and did a search for the registered agent name. It says it not registered. But the lady told me they would be because they have to protect their trademark. How can I get the name of a buisness owner??Please help. I am in oklahoma city. Can the US stop more Fakes? I think the US should create a new system for cracking down on Fake Products. I think fake products does affect companies in a huge way and it also affects the US economy. So creating a system like a police force country wide to crack down on Fake products been sold should be a top priority. Fines should be High, extremely high and jail time mandatory. Owners of trademarks should be able to propose their own Fee for each item found. All stores that sells products will have a random check for good to enforce stop fakes law. Companies that export fakes to the US should be on a Ban list as well as their exporting agent's office. I think fakes are very bad, because it takes so much time, energy and money to build a brand and then have it copied with no money coming to you from sales made.... maybe there are already a system in place but is it been enforced? or is it up to time with whats going on? This is just a question on my mind... Well that means the law is not a real law it's just a front. FDA yes but inventors cannot be eyes of the country. "Fakes" are products that are not made by the Trademark's Owner. Whether it be music or a pin with a name on it...
